The covenant at the centre of this case was agreed between Omaha Beach Ltd, a company that developed a residential subdivision at Omaha South, and the defendants, owners of land to the south of the subdivision. Some time prior to the present proceedings, Omaha Beach Ltd applied for resource consent to subdivide land at Omaha South. The defendant landowners objected to the application and lodged an appeal to the Environment Court. To resolve the dispute, Omaha Beach Ltd entered into a restrictive covenant by executing a memorandum of transfer in favour of the defendants. The operative clause was as follows: |
