Abstract:
While there have been a number of decisions considering the effect of entire agreement clauses on liability under the Fair Trading Act 1986 (FTA), Leigh v MacEnnovy Trust Ltd HC Auckland CIV 2009-404-3631, 31 March 2010(BC201061131) is of particular note in addressing the effect of such a clause on the remedies available under the FTA in the context of consumer transactions.
