By majority decision the House of Lords in Golden Strait Corp v Nippon Yusen Kubishika Kaisha found the "available market" rule did not do justice where the duration of a period charter was subject to an express contingency. This note doubts whether the correct questions were asked and speculates whether a different result would have been reached on more finely tuned evidence.
