Abstract:
This chapter considers the legal issues arising from kānuka and bioactive research. In particular, it considers the position of state law, tikanga Māori, mātauranga Māori and Indigenous peoples' rights as set out in international law (indigenous intellectual and cultural property). It also considers the status of kānuka as taonga within te ao Māori. This legal analysis contributes to a kānuka project currently being undertaken by Māori and commercial partners on the East Coast/Te Tai Rāwhiti.
